Offiical Rules and Regulations
(the “Rules”)
Jimmy’s Big Fat Giveaway (the “Contest”) is organized by Jimmy The Greek (the “Organizer”). The Contest begins on Sunday, August 21, 2023 at 4:00 PM ET (the “Contest Opening Date”), and ends on Sunday, September 10, 2023 at 4:00 PM ET (the “Contest Closing Date”).
The Contest is open to all residents of Canada (excluding residents of the Province of Quebec) who have reached the age of majority in their respective province or territory of residence by the Contest Opening Date, except for employees, agents, mandataries, and representatives of the Organizer, its subsidiaries, affiliates, affiliated companies, advertising or promotion agencies, advisors, the suppliers of material, prizes, and services related to this Contest, and any other stakeholder directly related to the organization and administration of the Contest, as well as the members of their immediate family (father, mother, brothers, sisters, children, and legal or de facto spouse) and anyone with whom these employees, representatives, and agents reside.
Ongoing eligibility to enter the Contest and to win a prize is conditional on agreement and strict compliance with these Rules of the Contest. One entry per person.
No purchase necessary. To enter the Contest, the contestant (the “Contestant”) must visit www.jimythegreek.com/bigffatgiveaway following the Contest Opening Date and submit the My Big Fat Giveaway Contest entry form (the “Form”) before the Contest Closing Date, to be automatically entered to win one (1) of six (6) My Big Fat Greek Wedding 3 prizes (each, a “Prize”). Entry must include: current and active and unique email address to be considered valid. The Form must be submitted in strict compliance with the Contest Rules and requirements, or may automatically be deemed disqualified without notice and without liability to the Organizer or any other party.
A Contestant can only be eligible to win one (1) Prize. In the event that a Contestant’s name and/or entry is drawn a second time, they will not receive a second Prize and a redraw may take place.
The Prize draw shall be held on September 11, 2023, in Toronto, Ontario at or around 2:00 PM ET. The draw shall select the potential winners at random from all eligible Contestant entries.
There are a total of six (6) Prizes available to be won: One (1) Grand Prize (as defined below) and five (5) Secondary Prize(s) (as defined below). Each Prize winner (a “Prize Winner” or “Winner”) will be randomly drawn from all eligible entries.
The total cumulative value of all Prizes is approximately $3,152.60 CAD, including applicable taxes.
The Prizes must be accepted as awarded and are not transferable or convertible to cash.
The Organizer reserves the right, in its sole discretion, to substitute alternate prizes of like kind and value for any and all elements of the prizing in this Contest, for any reason. Decisions by the Organizer are final and binding regarding all aspects of this Contest.
The Prize draws shall be held on September 11, 2023, at 2:00 pm Eastern Time in Toronto, Ontario.
Each selected Contestant will be notified on or around: September 11, 2023 that their name has been drawn (the “Winner Notification Date”). Contestants who have not been drawn will not be notified.
All selected Contestants will be contacted via the email they provided on their Form by the Organizer or its agents.
In order for a selected Contestant to be formally declared a Prize Winner of one of the Prizes, the selected Contestant must fulfill the specified conditions for eligibility. Each Contestant is eligible to win only one (1) Prize.
The odds of being selected as a potential Prize Winner are dependent upon the number of eligible entries received by the Contest Organizer prior to the Contest Closing Date. No specific number of Prizes will be allocated to any specific region or province/territory of Canada, provided that residents of the Province of Quebec are not eligible to participate in the Contest.
Before being formally declared a Prize Winner, each selected Contestant shall be required to: (i) respond to the Organizer’s notification of selection e-mail in the time period provided and accordance with the requirements therein (as such requirement is further described below); (ii) correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by a Jimmy The Greek staff member or representative in person or via video call within the specified time; (iii) comply with these Contest Rules at all times; and (iv) sign, complete, and return the Organizer’s form of release and waiver (as described below).
The selected Contestants will be notified in the manner set out above by the Contest Organizer on or around the Winner Notification Date. Each selected Contestant must respond to the Organizer’s notification e-mail, and the Contestant’s response to such e-mail must be received by the Organizer by the date specified in the notification (the “Response Period”). Such response e-mail must include all items requested in the Organizer’s notification e-mail, and failure to strictly comply with any requirements in the notification or these Rules may result in disqualification.
Any reference to “day” herein or in any Contest document, posting or notification, refers to a business day meaning any day that is not: a Saturday, Sunday or a statutory holiday in the Province of Ontario, and the end of the Business Day shall mean 5:00 PM Eastern Time, in Toronto, Ontario on that Business Day. For the purposes of calculating the Response Period, the day upon which notification was made by the Contest Organizer shall not be counted as part of the Response Period during which the selected Contestant must respond to the notification e-mail. If the selected Contestant does not respond within the specified Response Period, he/she will be disqualified without any liability to the Organizer and/or any other party, and he/she will not receive a Prize. Instead, another Contestant may be selected in the Contest Organizer’s sole discretion. The Contest Organizer is not responsible for the failure for any reason whatsoever of a selected Contestant to receive notification of their selection or for the Contest Organizer’s failure to receive a selected entrant’s response. Any issues arising due to technological or network failure, whether on the part of the Contestant, the Organizer, or any other party, shall in no way result in liability on the part of the Organizer or any other party.
If a selected Contestant: (i) cannot be located or contacted or does not reply to the Contest Organizer’s notification within the Response Period; (ii) has not fully complied with these Contest Rules or the requirements specified in the notification e-mail; (iii) does not correctly answer the mathematical skill-testing question or does not do so in accordance with the requirements herein or in the notification e-mail; or (iv) declines the Prize, then that Contestant’s entry is disqualified, the Prize is forfeited, and the Contest Organizer may, but is not obligated to, select another entrant from the remaining eligible entries received during the Contest Period (not including the entries chosen for the other Prizes) for a chance to receive the applicable Prize. The Contest Organizer reserves the right to not select another entry or award a Prize if any of the events described above occur.
Winner(s) may claim his/her/their Prize or the Contest Organizer will distribute the Prize(s), as the case may be, in the manner described in the Winner notification e-mail.
Contest Organizer reserves the right in its sole discretion to disqualify any Contestant from the Contest and to ban that individual from any future contest of the Contest Organizer if Contest Organizer finds or believes (acting reasonably) such individual to be: tampering with the Contest, including (but not limited to) the entry process or the operation of the Contest or, where applicable, the Contest website; acting in violation of the Contest Rules; or acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass Contest Organizer, Contest Organizer’s agencies, other Contestants or any other persons. Any attempt by a Contestant or any other person to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Contest Organizer reserves the right to seek damages from any such person to the fullest extent permitted by law.
The Contest Organizer and its officials, its advertising, media buying and promotional agencies, Elevation Pictures Corp., the suppliers of material, Prizes and services related to this Contest, and any other stakeholder directly or indirectly related to the holding of the Contest, and their respective directors, officers, employees, suppliers, agents, sponsors, contractors, administrators, licensees, and representatives (collectively, “Contest Entities”) accept no responsibility whatsoever for any injury, loss, or damage that any Contestant, or any other person, may suffer in connection with the Contestant’s, or any other person’s, participation in the Contest or any Contest-related activity and/or the Contestant’s, or any other person’s, acceptance, use, redemption, or misuse of any Prize; any breach of the Contest Rules by the Contestant or any other person; the conduct of the Contest; the operation of the website through which Contestants may submit entries to the Contest; any alternate method of entering the Contest; or any third party claims in relation to the Contest (collectively, “Claims”). By entering the Contest, each Contestant irrevocably releases and indemnifies the Contest Entities from and against any and all Claims that the Contestant may have against the Contest Entities and/or in relation to the Contest. Each Winner will be required to sign and return, within the time period determined by the Contest Organizer, a declaration of compliance with these Rules and a full liability and publicity release and/or any other document required by the Contest Organizer in relation thereto.
The website through which the Contest is offered, and all software and hardware used to operate the website, are made available for Contestants to enter the Contest on an “as is” basis without warranty of any kind, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. There are no warranties that the Contest website or the software and hardware used to operate it will be uninterrupted or error-free, that defects will be corrected, that it is free of viruses, worms or other harmful components, that entries will be received or processed, or that the Contest website or the software and hardware used to operate it are accurate, reliable, and/or secure. In no event will the Contest Entities be liable for any lost or damaged data, or any lost or damages entries. None of the Contest Entities shall be responsible for lost, stolen, delayed, damaged, or misdirected entries, or for any failure, or for any problems or technical malfunction of any internet or telephone network or broadcast transmission during the Contest Period. Without limiting the release of liability provisions herein, and for greater certainty, the Contest Entities will not be liable for: (i) any incorrect or inaccurate information, whether caused by Contest website users or by any equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the processing of entries in the Contest; (ii) any error, omission, interruption, deletion, defect or delay in operation of the Contest website or any transmission in connection with the Contest; (iii) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; (iv) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or (v) any injury or damage to Contestants or to any other person’s computer related to or resulting from participating or downloading materials in this Contest.
If for any reason this Contest is, in the Contest Organizer’s sole discretion, not capable of running as planned, has been interfered with so as to render it unfair, or otherwise poses a risk of inflicting harm on third parties (including, without limitation, by reason of damage (or risk of damage) by computer viruses, worms, bugs, tampering, unauthorized intervention, human error, fraud, technical limitation or failures, applicable law, unforeseen obstacles, or any other causes which in the sole opinion of Contest Organizer, acting reasonably, could corrupt, compromise, undermine or otherwise affect the administration, security fairness, integrity viability or proper conduct of the Contest), Contest Organizer reserves the right in its sole and absolute discretion to modify these Rules and/or to modify or suspend all or any part of the Contest. Contest Organizer further reserves the right to cancel or terminate this Contest at any time for any reason with no further liability whatsoever to itself or any other party. Contest Organizer reserves the right to select Contestants to be eligible to win a Prize(s) from among all eligible Contestants received up to the time of any such cancellation, termination, modification or suspension, as applicable.
By entering this Contest, each Contestant acknowledges and agrees that the Contest Rules are legally binding. All decisions of the Contest Organizer and any Contest judges, if applicable, are final and without appeal in all matters relating to this Contest and the awarding of a Prize. All entries shall become the property of the Contest Organizer.
This Contest is governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein.
All personally identifiable information (collectively, “Personal Information”) collected in connection with this Contest will be used solely for purposes of administering this Contest and for publicity and promotional purposes relating to the Contest, and for any consistent purposes. This Personal Information will not otherwise be sold or transmitted to third parties except to third-party agents and service providers in connection with administration of the Contest, including the purposes herein. Names of Winner(s) may be published by the Contest Organizer. By entering the Contest, each entrant grants his/her/their permission for the collection, use and disclosure of his/her/their Personal Information submitted to the Contest organizer for the foregoing purposes.
By participating in the Contest, each Winner agrees that his or her name, province or territory of residence, any statements made relating to the Contest, and any photograph or other likeness (if applicable) of the Winner may be used by the Contest Entities for any and all commercial purposes in any and all media relating to the Contest or their status as Winners, whether now known or hereafter devised, without further permission or compensation, including, without limitation, in any advertising or broadcasting material relating to the Contest, except where prohibited by law.
Contestant agrees that all copyright in his/her/their completed entry form and in any material depicting the Contestant’s likeness or other information about the Contestant (but excluding any Personal Information) shall be vested in the Contest Organizer and Contestant hereby irrevocably assigns all of his/her/their worldwide intellectual property rights in and to such entry form and materials to the Contest Organizer and waives all moral rights therein.
By entering the Contest, each Contestant agrees to be bound by these Rules.
All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, websites, source codes, images, drawings, illustrations, slogans, and representations (collectively, “Intellectual Property”) relating to “JIMMY THE GREEK” is owned by the Organizer and/or its affiliates. All Intellectual Property relating to “MY BIG FAT GREEK WEDDING 3” in Canada is owned by Elevation Pictures Corp. and/or its affiliates. All rights reserved. Unauthorized copying or use of any of the Organizer’s or any other parties’ Intellectual Property without the express written consent of the respective owner is strictly prohibited.
Although the Contest and associated content may be accessed through Facebook, Twitter, Instagram, and/or other social media platforms, the Contest is in no way sponsored, endorsed, or administered by, or associated with, such social media platforms. Although such social media platforms are not Contest Entities, by entering, each Contestant agrees to fully release and indemnify Facebook, Twitter, Instagram, and all other applicable social media platforms from any and all liability associated with the Contest as if they were Contest Entities. All information provided in the Contest is provided to Organizer, and not to such social media platforms.
